These terms apply to the entire content of this website (MC Connect), which you agree to by using this website. Otherwise, please do not use this website.

The Marlburian Club/Marlborough College (both referred to as "the College" in this document) may update these terms from time to time and any changes will be notified and effective immediately. You further agree that these terms are also applied to our supplier, Aluminati Network Group Ltd ("Aluminati"), who host these pages on our behalf. Aluminati is acting under instruction as the College's Data Processor under the UK data protection legislation. Aluminati will process personal data strictly for the purposes of operating this service. Aluminati is registered with the Information Commissioner under membership number Z8393842. Aluminati is a trusted third-party partner of the College and is contractually bound to provide this service to the College and Old Marlburians (OMs), parents and staff.

MC Connect (the software platform) allows users to update their details online, access a directory of OMs, parents and staff, and, subject to an individual registrant's authorisation, participate in online mentoring programmes. To enable us to offer this service some of your personal information will be stored in MC Connect. Both the College and Aluminati undertake to handle your personal information responsibly and in accordance with their respective duties under the most up-to-date UK legislation.

These terms are applicable in conjunction with the College's Privacy Notice.

Additional terms for College staff

The use of this website by College staff is subject to the College's Online Safety Policy and ICT Acceptable Use Policy. College staff should always use their College email address for MC Connect. Caution is advised when communicating with recent leavers. All contact should be professional only and any concerns should be reported immediately to the Designated Safeguarding Lead. Staff should also consider what personal information to make available on MC Connect given that it may be visible to other users. Use of the privacy controls is strongly advised: see Information about you and your visits to our site section for more information.

Use of the website

OMs may request access to MC Connect by using the Sign-Up functionality. Access will be granted once the information has been verified. Staff and parents can only access the website upon receiving an invitation from a registered member of staff. Please note that some areas of this website are only available to College staff, OMs, parents and/or other authorised users.

You must not use this web site or any facilities or information which are available through it to:

  • Commit or encourage unlawful acts or acts which breach of these terms of use;
  • Misrepresent your identity;
  • Hack, or attempt to hack, any part of the web site or any system used to run it;
  • Store personal data derived from the web site;
  • Post material that is obscene, offensive, or otherwise unlawful;
  • Technically harm the web site and/or its systems (including, without limitation, computer viruses or malicious software or harmful data).

While the College/Aluminati tries to make this website available 24 hours a day, it reserves the right to suspend or withdraw access, without notice, to either the whole or part of the website, for any reason.

Accessing our site

Your user password and any other piece of information provided as part of our security procedures are confidential. You must not disclose it to any third party. You are responsible for making all arrangements necessary for you to have access to the site. You are also responsible for ensuring that all persons who access the site through your internet connection are aware of these conditions and comply with them. Access to the site is always at the College's discretion and the College may withdraw or amend the services provided on the site without notice. From time to time the College may restrict access to some or all users to some or all parts of the site and sometimes the site may be unavailable. You use the site and the internet in general at your own risk.

We use reasonable efforts to ensure the continuous operation and availability of the site and we use technologies to keep users' data safe and accurate, but we cannot and do not guarantee these things. Where possible, we will post advance notice on the site where downtime is scheduled for maintenance. As is normal, you note the need to maintain backup copies of any important data.

If the College determines that you have breached any of these conditions, it may take such action as it deems appropriate, including disabling your password whether chosen by you or allocated by us. You agree to indemnify us for all claims brought by a third party against us arising out of or in connection with any breach by you of any warranty set out in the conditions.

Information about you and your visits to our site

MC Connect contains a directory of names of OMs, parents and staff. Through using the service and creating an online profile or mentoring profile, certain information provided by you (including your name, personal headline, biography, professional history, education details, email address and LinkedIn profile) will be accessible to other individuals who have registered for MC Connect (depending on what information you choose to share). These may be staff, OMs or parents. MC Connect acts as a messaging forwarding service but your email address itself will remain anonymous to other users unless you choose to share it. You warrant that all data you provide is true and accurate.

Any information you submit to this website will also be visible to Aluminati employees for the purpose of managing the service. The College processes the information about you in accordance with our Privacy Notice, which forms part of these conditions.

Personal data of OMs, parents, staff and other stakeholders is transferred and stored by the College into a propriety cloud-based database supplied by Blackbaud, Inc. called The Raiser's Edge (RE NXT) under a contract for service. RE NXT is hosted by Blackbaud on their servers located in the EEA. This database is protected by multi-level authentication and access is restricted to individuals who need to see the data to carry out their duties at the College.

If you partake in any mentoring schemes offered as part of MC Connect, additional terms and conditions apply. You will be presented with these upon accessing the mentoring area of the service and must agree to them before you can continue.

The College’s legal basis for processing personal information and further information on the information we collect and how we use it is contained in the Privacy Notice (https://www.marlboroughcollege.org/privacy/). Disclaimer

While the College tries to ensure that the information on this website is accurate at the time of publication, it does not warrant that this is the case. To the fullest extent permitted by law, the material on this website is provided "as is", and without warranties, conditions or other terms of any kind. Nothing on this website constitutes any part of a contract unless otherwise expressly stated.

The presence of platform members working for organisations on the Directory, mentoring programme or any other elements of the system does not infer an endorsement of that organisation by the College.

Liability

To the fullest extent permitted by law, the College excludes all liability and responsibility for any amount or kind of loss or damage that may result to you or a third party in connection with the use of this website in any way. Nothing will limit the College's liability for death or personal injury caused by its negligence or for fraud. Every effort is made to ensure downloadable content is free from viruses, but the College accepts no liability for damages resulting from virus infection.

Governing Law and Jurisdiction

These terms of use are governed by English law. Disputes arising in connection with them shall be subject to the non-exclusive jurisdiction of the English courts.

Miscellaneous

No waiver by the College of any breach of these terms by you shall be considered as a waiver of any subsequent breach of the same or of any other provision. If, at any time, any provision of these terms is or becomes invalid or illegal in any respect, such provision shall be deemed to be severed from the terms, but the validity and enforceability of the remaining provisions shall not be affected as a result.
